Bisley-with-Lypiatt
On 25th July 2019 the Parish of Bisley-with-Lypiatt was conferred with the status of Neighbourhood under the Localism Act 2011 and Part 2 of The Neighbourhood Planning (General) Regulations 2012. The following documents are available:

For the purpose of demonstrating that the NDP is unlikely to have significant effects on the environment; as required by regulation 15 of the Neighbourhood Planning (General) Regulations 2012 (as amended by the Neighbourhood Planning (General) (Amendment) Regulations 2015), the above document comprises Stroud District Council’s statement of reasons.
Pre-submission Consultation and Publicity - 13th October to 28th November 2025 (Concluded)
Notice of publication of the Slimbridge Neighbourhood Development Plan proposal under Regulation 16 of the Neighbourhood Planning (General) Regulations 2012 (As Amended) and the Localism Act 2011.
The period for making representations ran from 06 March 2026 to 16 April 2026.
Independent Examination
Stroud District Council appointed Deborah McCann as independent examiner of the plan.

Bisley with Lypiatt Neighbourhood Plan: Additional focused consultation on legal changes
Bisley with Lypiatt Parish Council produced the Neighbourhood Plan and submitted it to Stroud District Council in March 2026. The plan was subject to a public consultation between 06 March 2026 and 16 April 2026. Responses to that consultation during that period were passed to an independent examiner, who began formally reviewing the plan in June 2026.
However, since the submission of the Neighbourhood Plan, changes were introduced to the legislation governing neighbourhood planning.
On 25 March 2026, sections 98 and 99 of the Levelling-up and Regeneration Act 2023 came into effect, and these amended the Planning and Compulsory Purchase Act 2004 and the Town and County Planning Act 1990 in respect of the legal compliance and the Basic Conditions requirements for neighbourhood plans.
As a result, the independent examiner has requested that a further consultation be carried out.
This additional stage, from Wednesday 15 July until 17:00 on Wednesday 29 July 2026 will focus specifically on whether the Bisley with Lypiatt Neighbourhood Plan complies with two new legal compliance requirements and one new Basic Condition requirement
Legal changes
On 25 March 2026 sections 98 and 99 of the Levelling-up and Regeneration Act 2023 came into force, by virtue of The Levelling-up and Regeneration Act 2023 (Commencement No. 11 and Saving and Transitional Provisions) Regulations 2026, which were made on 2 March 2025.
In relation to neighbourhood plans, sections 98 and 99 amend the Planning and Compulsory Purchase Act 2004 and the Town and Country Planning Act 1990 in respect of the legal compliance and the Basic Conditions requirements.
In summary, the further legal compliance requirements are as follows:
- so far as the qualifying body considers appropriate, and having regard to the subject matter of the plan, the plan must be designed to secure that the development and use of land in the neighbourhood area contribute to the mitigation of, and adaptation to, climate change; and
- so far as the qualifying body considers appropriate, and having regard to the subject matter of the plan, the plan must be designed to take account of any local nature recovery strategy under section 104 of the Environment Act 2021 that relates to all or part of the neighbourhood plan area.
In addition, there is a new Basic Condition requirement:
- the making of the neighbourhood development plan would not result in the development plan for the area of the authority proposing that less housing is provided by means of development taking place in that area than if the neighbourhood development plan was not to be made. Note: this replaces the former Basic Condition that the neighbourhood plan be in general conformity with the strategic policies contained in the development plan for the area.
A further Basic Condition related to the new environmental assessment framework is commenced albeit, until such time as a completed framework for the implementation of Environmental Assessment Reports is in place, compliance with this Basic Condition cannot be assessed.

The additional focused consultation is open to ONLY those who made representation at Regulation 16 stage of the Neighbourhood Plan.

Given the focused nature of the consultation, we are inviting written responses in relation only to whether you consider that there are any implications for the Bisley with Lypiatt Neighbourhood Plan arising from the legal changes.
Please note there is no need for responses to repeat representations that have already been made in relation to any other matters (since the Regulation 16 representations stand as submitted). Similarly, it is not an opportunity to raise new matters that do not relate to the legal points.

Following the closing date for responses, the District Council will forward the responses received to the appointed Examiner, Deborah McCann.
