A property development company has been fined after admitting to burning waste and emitting dark smoke from an industrial site in Stroud, in breach of environmental protection laws.

Dream Home Developments Limited pleaded guilty at Cheltenham Magistrates’ Court to an offence under the Clean Air Act 1993, following an investigation by Stroud District Council’s Environmental Protection team.

The offence took place on part of the former Redler site, where officers noticed a large bonfire on 6 November 2024. The investigation revealed that burning of materials produced dark smoke – a clear breach of clean air regulations.

The court imposed the following penalties: a fine of £1,400 (reduced from £2,000 due to an early guilty plea), £560 Victim Surcharge, costs of £2,891.20 to Stroud District Council. 

Environmental Protection Officers have seen a rise in complaints in recent months about the burning of controlled waste on commercial premises. The burning of trade waste is strictly regulated and can only be carried out under an Environmental Permit or a formal exemption. Emissions of dark smoke from such activity are a criminal offence under the Clean Air Act 1993.

Councillor Martin Pearcy, Chair of Stroud District Council’s Environment Committee said: “This case sends a clear message that we will take enforcement action where businesses fail to comply with environmental laws. Burning trade waste not only harms our air quality but also puts public health at risk. We urge all businesses to dispose of waste responsibly and in accordance with the law.”

Bonfires are not an acceptable method of waste disposal, and enforcement action will be taken where necessary to protect the environment and public health.
