Stroud District Council is in the process of reviewing some Public Space Protection Orders.
The survey will help to inform us in regard to extending our Public Space Protection Orders for dog control across the district and prohibiting alcohol consumption in designated places (Stroud Town and Dursley Town).
What is a Public Space Protection Order?
A PSPO is a Public Spaces Protection Order, and it is used to tackle anti-social behaviour issues and was introduced by the Anti-social Behaviour, Crime and Policing Act 2014. If people break the conditions of the PSPO they can be issued with Fixed Penalty Notice and face prosecution.
The following survey provides a framework for responding to the consultation in respect of the extension of Public Spaces Protection Orders (PSPOs) for dog control and prohibiting alcohol consumption in designated places for a further 3 years. However, your responses are welcomed in any alternative formats that you may prefer to utilise.
For information purposes, please bear in mind that a PSPO must meet two grounds to be lawful, as follows:-
- The activities carried out in a public place must have a detrimental effect on the quality of life of those in the locality or it is likely that they will do so; and
- The effect, or likely effect, of these activities is of a persistent or continuing nature, is unreasonable and justifies the restrictions imposed by the Orders.
Before we extend our PSPOs we need consult with the Police, owners, or occupiers of land within the affected area where reasonably practicable, appropriate community representatives and the public.
As a PSPO can last for up to three years, it is important for us to focus on long-term issues which affect people who live, work and visit the Stroud District.
