Conservation Area Consent

Conservation area consent is needed before you may demolish most types of building or structure in a conservation area. There are various exceptions to this requirement, such as small buildings with a total volume of less than 115 cubic metres (about 20 foot square by 10 foot high), walls next to the highway under one metre high, and listed buildings (which, instead require listed building consent).

Conservation area consent is only required for:

  • Total demolition of a building;
  • Very substantial destruction of a building (perhaps leaving just one wall of the building); or,
  • Demolition of a distinct part of a building, such as the removal of a clearly defined wing.

Consent would not be required for the 'partial' demolition of, for example, the roof and first floor of a building, nor for the demolition of part of a boundary wall to incorporate a gateway.

If you are considering carrying out any demolition in a conservation area you are advised always to consult a planning officer first. It is a criminal offence to carry out demolition requiring conservation area consent without the benefit of that consent. Ignorance is not a defence.

Before filling in this form please read all the guidance notes carefully. An incomplete form, or insufficient supporting information, may necessitate a re-submission and consequent delay.

Five copies of the form, and of all accompanying documents and plans, are required. The exceptions are the forms regarding ownership and permission to display notices. Only one copy of each of these is needed.

The Council will always need to know what is to be done with the site after demolition. If redevelopment is proposed the Council will require the submission of a planning application for that development, to be considered in parallel with the application for conservation area consent. The method of demolition may also have to satisfy the requirements of the Building Regulations.

There is no charge for processing conservation area consent applications.

Applicants should note that the proposals will be publicised in the press and on site.

Question 1 Name & Address of Applicant and Agent

If an agent (eg a surveyor or architect) submits the application on your behalf the Council will normally address all correspondence to the agent's named contact.

Question 2 Postal Address or Location of the Application Site

Where the site is not precisely identified by a postal address an eight figure Ordnance Survey grid reference may also be required.

Question 3 Extent of Proposed demolition

Please give a brief but accurate description, including where there may be any ambiguity, reference to buildings or structures to be retained, eg:- Demolition of the complete stable block, but retention of the attached dwelling house.

Question 4 Use of Property and Site

Your answer should cover all parts of the building, including any parts to be retained eg:-
Stable Block, (to be demolished) ground floor storage, first floor vacant.
House (to be retained) in use as three, self contained flats.

Question 5 Declaration

The Council must have full information, in order to understand your proposals, before it can process your application. Some of the documents and drawings listed below are essential for all applications. Others may not all be asked for, but it is essential to provide them if they are requested. Please consult a planning officer if in doubt.

The Council is not authorized to consider an application for Conservation Area Consent without the completed Certificate A or B.

Please read the notes on the certificate before completing either Certificate A, if you are the sole owner of the property or B, in most cases where you are not. If you are not the sole owner you will also need to complete Notice 1 (on the reverse side) or, if you do not know who the owner is, you will need to obtain Certificate C and another notification form from the Council, as explained on the form.

The Council has to post notices of your application on site. Please complete the "Authority to Display a Site Notice" form to help speed up this process.
