Arrangements for the Retention or Deletion of Local Plan Policies.
The Policies of the Local Plan will expire on 10 November 2008 unless agreed to the contrary by the Secretary of State (SOS), in which case individually they will remain in place for a further period determined by the SOS or until superseded by policies within the new Local Development Framework.
Please note under the transitional arrangements of the Planning and Compulsory Purchase Act 2004 some policies of the Local Plan are not proposed to be 'saved'. If the SOS agrees, they will be deleted as they have been superseded by national guidance or events such as the delivery of development.
The following tables set out the Council’s latest position regarding the policies of the Local Plan which it is proposed to ‘save’ or ‘not save’. This is subject to a suitable Direction being granted by the SOS.
The last column of the tables gives the reasons for the Council’s proposed action in respect of each policy. The preceding columns provide guidance in respect of the Government’s criteria for the proposed retention or deletion of the policies concerned. It should be noted that the final decision on whether policies will be deleted or retained will be made by the Secretary of State and not the District Council.
This matter was initially considered by the Cabinet of the Council on 10 July 2008 and will be considered by the full Council at its meeting on 18 September 2008. After this date the matter will be formally forwarded to the Secretary of State for determination.
Local Development Framework
In addition, the Council is responsible for preparing the authority's Local Development Framework (LDF) that will eventually replace the current Local Plan. It will be a portfolio of Local Development Documents.
